Victoria’s Model Litigant Guidelines aim to regulate the conduct of government parties in civil disputes in a manner that goes beyond the ethical duties of ordinary litigants. Despite the sheer number of disputes involving the Victorian government to which the regime applies, little academic attention has been given to Victoria’s MLGs. The article explores the nature and extent of the regulatory force exerted by the MLGs by applying regulatory theory to the MLG regime. Particular attention is given to applying Ayers (...) and Braithwaite’s theory of Responsive Regulation that includes situating the guidelines within their regulatory pyramid. The analysis finds that in the absence of a distinct regulator, the MLG regime is predominantly self-regulatory. The responsiveness of the MLGs appears to be restricted owing to an absence of public involvement in the MLG regime. The article also highlights that likely challenges to the MLG regime as a mode of regulation include the nature of the regulatory context, the decentralisation of government services, the lack of publicly available information on the government’s adherence to the MLGs and the content of the MLGs themselves. Fundamento: la historia del hospital Manuel Ascunce Domenech comenzó en 1946. Objetivo: Resaltar la importancia que tuvieron los trabajadores y decisores en la evolución histórica de la institución. Método: Es una investigación histórica basada en la investigación documental, se utiliza el submétodo cronológico para establecer el orden de los hechos que se describen. Se hicieron entrevistas a personalidades que laboran en el hospital desde o cercano a su fundación el 14 de enero de 1962 y se revisaron algunos artículos históricos (...) publicados. Resultados: Fueron necesarios 16 años desde que el gobierno de turno en el 1946 procediera a la segregación y compraventa de una parcela de terreno para la construcción del Hospital hasta su inauguración. Solo con el triunfo de la revolución y la voluntad política se pudo terminar la obra. Conclusiones: El Hospital ha cumplido una importante función asistencial, docente, gerencial e investigativa. Method: It is a historical research based on the documental research. The chronological sub method is used with the purpose to establish the order of the facts that are described here. Interviews to personalities that work in the hospital from or near the date of foundation on January 14, 1962 were made and some published historical articles were revised. Results: a period of 16 years was necessary since 1946 when the government of that moment proceeded to segregation, sale and purchase of a land parcel for the construction of the Hospital until its inauguration. The building work was possible to conclude just with the victory of the revolution and its political will. En este artículo se concibió la oponencia como forma de crítica científica. Se realizó un análisis del ejercicio de oponencia por los problemas identificados en la Universidad de Ciencias Médicas de Camagüey, desde el pregrado hasta el postgrado en la realización de los informes finales de investigaciones, tesis y publicaciones. El objetivo fue valorar la oponencia como forma madura y ética de la crítica científica. Se propuso una metódica para el ejercicio de la oponencia contentiva de la selección del oponente, (...) conocimiento del investigador, acercamiento al trabajo investigativo y el juicio crítico al evaluar y emitir veredicto. De igual forma se expusieron requisitos para realizar una buena oponencia, así como elementos en la estructura de un informe de oponencia que no deben faltar, con independencia del nivel en el cual se realice. The importance of teaching aids in students' training, their development and contribution to solve issues related to care and quality of the health system, the lowering of adverse events and the patient´s safety are pointed out. Curricular strategies related to Nursing represent a particular way to develop the teaching process, characterized by a coordinated direction which responds to the graduate's experience, in which theoretical and practical methods and contents of the curricular units that belong to the syllabus are interwoven, starting from a methodological structure that ensures these strategy functions. Evidence-Centered Design (ECD) is a framework for the design and development of assessments that ensures consideration and collection of validity evidence from the onset of the test design. Blending learning and assessment requires integrating aspects of learning at the same level of rigor as aspects of testing. In this paper we describe an expansion to the ECD framework (termed e-ECD) such that it includes the specifications of the relevant aspects of learning at each of the three core models in the (...) ECD, as well as making room for specifying the relationship between learning and assessment within the system. The framework proposed here does not assume a specific learning theory or particular learning goals, rather it allows for their inclusion within an assessment framework, such that they can be articulated by researchers or assessment developers that wish to focus on learning. In this paper, we have developed an Excel package to be utilized for calculating neutrosophic data and analyze them. The use of object oriented programming techniques and concepts as they may apply to the design and development a new framework to implement neutrosophic data operations, the c# programming language, NET Framework and Microsoft Visual Studio are used to implement the neutrosophic classes. The study aimed to identify the creative environment of the technical colleges operating in Gaza Strip. The analytical descriptive method was used through a questionnaire which was randomly distributed to 289 employees of the technical colleges in Gaza Strip with a total number of (1168) employees and a response rate equal to (79.2%) of the sample study. The results confirmed the existence of a high degree of approval for the dimensions of the creative environment with a relative weight of (75.19%) (...) according to the perspective of the employees of the technical colleges in Gaza Strip. The results of the study showed a high level of creative environment (fluency, flexibility, originality, sensitivity to problems) in the technical colleges in Gaza Strip, where the field (fluency) ranked first and relative weight (76.86%), in the second place came the area (sense of problems) and relative weight (74.89%). The field of elasticity came in third place with a relative weight of (74.59%). Finally, the field of originality came in fourth and final rank with a relative weight of (74.41%). The results showed that there are differences between the technical colleges in the principles of the creative environment in all fields and the overall degree except for the field of flexibility. The most available colleges in these principles were the university college of applied sciences, and that was the least of the Faculty of Al-Aqsa Society. The results showed that there were differences according to the age variable in the areas of creative environment only in the sense of problems for age groups (less than 30 years) and (from 40 to 50 years). The researchers suggested a number of recommendations, the need to enhance the dimensions of the creative environment in technical colleges by working to improve the faculties of fluency, flexibility, originality and sensitivity to problems. The need to work on continuity and improve aspects of the creative environment of the colleges and the creation of new and innovative ways to support and develop and support these aspects combined. Necessity of technical colleges to continue to develop the creative environment (fluency, flexibility, originality, sensitivity to problems) for employees by engaging them in specialized training courses for creative thinking and problem solving. Developing work procedures with new innovative methods that will accomplish the various tasks quickly and accurately, and provide the effort, time and costs. The study aimed to identify the intermediate role of the standard of operations in the relationship between the focus on students and beneficiaries in achieving satisfaction of students in Palestinian universities. The study used the analytical descriptive method. The study was conducted on university leadership in Al-Azhar, Islamic and Al-Aqsa Universities. The study sample consisted of (200) individuals, 182 of whom responded, and the questionnaire was used in collecting the data. The results of the study were as follows: - There (...) is a statistically significant effect on the adoption of the criterion of focus on the students benefiting to achieve the satisfaction of students in the Palestinian universities, where the value of R Square (35.3%), there is a statistically significant effect on the adoption of the criterion of focus on the students benefiting on the use of the standard of operations in Palestinian universities. The value of the R Square is (62.8%), there is a statistically significant impact of the criterion of operations on the satisfaction of students in Palestinian universities. Where the value of the R is (36.2%), there is a significant effect on the adoption of the criterion of emphasis on students benefiting from the satisfaction of students in Palestinian universities with the existence of the standard of operations as an intermediary variable. The role of the mediator in the relationship between the adoptions of the criterion of focus on the students benefiting to achieve the satisfaction of students in Palestinian universities was revealed through the use of Path Analysis. The study presented a number of recommendations, the most important of which is: to increase the focus of the universities on students and beneficiaries in a manner appropriate to achieve the objectives of the university on the one hand, and students and beneficiaries on the other, and in line with the approach of quality and excellence, the universities more attention to the management of operations through the design and development of programs Academic and internal services according to the needs of students, and improving processes in innovative ways to generate added value for students and beneficiaries, the universities have made more efforts to create satisfaction among students and beneficiaries by developing internal performance indicators to measure student satisfaction, Students and other university beneficiaries periodically to improve their satisfaction. The ternary xV2O5–(40 − x)Li2O–60B2O3 glass system, where x = 1, 2, 3, 4 and 6 mol%, was prepared by normal quenching. Ultrasonic velocities and attenuation were measured at room temperature using a pulse-echo technique. Various parameters, such as elastic moduli, micro-hardness, Poisson's ratio and Debye temperature, were determined from the measured densities and velocities. The composition dependence of these parameters, in addition to the glass-transition temperature, suggested that vanadium ions were incorporated into these glasses as a network modifier, resulting (...) in the reconversion of BO4 tetrahedra to BO3 triangles by the breaking of B–O–B linkages and the formation of nonbridging oxygens (NBOs). The outcome was a reduction in network connectivity and rigidity with increasing V2O5 content. The results are explained quantitatively in terms of fractal bond connectivity, average atomic volume, network dimensionality, packing density, number of network bonds per unit volume, cross-link density and atomic ring size. The Makishima and Mackenzie model appears to be valid for the studied glasses when the fate of BO4 tetrahedra and creation of NBOs are taken into account. (shrink)

The aim of the study was to identify the organizational structure and its relation to the prevailing pattern of communication in the Palestinian universities. The researchers used the analytical descriptive method through a questionnaire randomly distributed among Palestinian university workers in the Gaza Strip. The study was conducted on a sample of (274) administrative staff from the three universities, and the response rate was (81.87%). The study found that there is a high satisfaction with the nature of the organizational structure (...) in the Palestinian universities from the point of view of the administrative staff, which reached 68.05%. And that there is a high level of communication pattern prevailing from the point of view of administrative staff, where the percentage (71.32%), there is a direct correlation between the nature of the organizational structure and the prevailing pattern of communication, the absence of differences between the sample according to the gender variable in their perception of the nature of the organizational structure and the prevailing pattern of communication, the absence of differences in the perception of employees of the nature of the organizational structure and the pattern of communication prevailing according to the variable age. There are differences of statistical significance in the perception of the nature of the organizational structure and the pattern of communication depending on the variable of scientific qualification in the organizational structure, and the pattern of communication. Differences were in favor of diploma holders compared to other practical qualifications. In this paper, a mathematical model was used to evaluate a dynamical hybrid system for optimizing and controlling the efficacy of plant-based protein in aquafeeds. Fishmeal, raw rapeseed meal, and a fermented meal with yeast and fungi were used as test ingredients for the determination of apparent digestibility coefficients of dry matter, crude protein, crude lipid, energy, and essential amino acids for olive flounder using diets containing 0.5% Cr2O3 as an inert indicator. Among all ingredients tested, FM had the maximum (...) ADC of dry matter, and energy. Fermented meals showed higher ADC. Amino acid digestibility reflects protein digestibility in most cases. Interestingly, protease, lipase, and amylase activities were better expressed in RM-Koji, RM-Yeast, and FM over RM, respectively. The current results deliver important information on nutrients and energy bioavailability in raw and fermented RM, which can be implemented to accurately formulate applied feeds for olive flounder. Compared with other applicable systems, the complexity of the approach implemented has been considerably reduced. (shrink)

The aim of the research is to shed light on the nature of the organizational structure prevailing in Palestinian governmental universities and to identify the most important differences in the perceptions of employees of the organizational structure in the Palestinian governmental universities according to the demographic and organizational variables. The researchers used the descriptive analytical method, through a questionnaire randomly distributed to the sample of the employees of Al-Aqsa University. The study was conducted on a sample of (80) administrative staff (...) from Al-Aqsa University. The study found that there is a moderate degree of satisfaction with the nature of the organizational structure prevailing in the Palestinian governmental universities from the point of view of the administrative staff, with a percentage of (63.11%). The absence of differences between the sample according to the gender variable in their perception of the nature of the organizational structure prevailing at Al-Aqsa University, the absence of differences in their perception of the nature of the organizational structure depending on the age variable. There are statistical significance differences in the perception of the elements of the organizational climate depending on the variable of scientific qualification in their perception of the nature of the organizational structure in favor of holders of a bachelor's degree, the absence of differences in their perception of the nature of the organizational structure depending on the variable years of service, and the absence of differences in their perception of the nature of the organizational structure depending on the variable level of career (Director, Head of Department, and Administrative Officer). The study reached a number of recommendations, the most important of which is that the management of the Palestinian governmental universities in general and Al-Aqsa University in particular should be given special attention to the organizational structure and modified in a way that achieves the goals of the university and the aspirations of the employees. The universities should have the opportunity to participate in the restructuring of the organizational structure, the importance of solving the problems of employees and giving them the opportunity to contribute to solving their own problems, and the need to use the method of rotation of employees and periodically. The study aimed to identify the reality of technical education in Palestine. The analytical descriptive method was used in the study. A questionnaire which consisted of 41 paragraphs was distributed randomly to the technical colleges in Gaza Strip. Random sample of (275) employees of these colleges were used, and the response rate was (74.5%). The results showed a high degree of approval for the dimensions of technical education with a relative weight of 76.07%. The ranking and relative weight was as (...) follows: Technical education institutions: 79.51%, graduates of technical education 75.75%, Labor market and local community 72.96%. This article investigates the impacts of proper modeling of the wake effects and wind speed delays, between different wind turbines' rows, on the dynamic performance accuracy of the wind farms models. Three different modeling scenarios were compared to highlight the impacts of wake effects and wind speed time-delay models. In the first scenario, wind wake effect and time delay are ignored. Consequently, all wind turbines are assumed subjected to the same wind speed profile. The second scenario considers the wind wake (...) effect, and it was modeled by reducing the incident wind speed values by 0.5 m/s from one row to the next row facing the wind. The last scenario, the proposed model, used the wind wake effect model developed for wind turbines micrositting applications and considered the effect of the delay time between the wind speed profiles incident on the different wind turbines' rows. This study aims to identify the electronic banking services in Palestine from the point of view of the customers of the banks, where researchers used the descriptive analytical method, through a questionnaire distributed electronically to the sample of beneficiaries of the electronic banking services provided by banks operating in Palestine. The study reached a number of results, the most important of which are: There is a moderate degree of efficiency of electronic banking services provided in banks operating in Palestine from (...) the point of view of bank customers. Where the total score of electronic banking services received a relative weight of (64.37%), the results of the study confirmed that the ranking of electronic banking services as follows: Internet banking services ranked first with a relative weight (66.68%), a medium percentage, while ATM services came in Second place with a relative weight (64.30%), and mobile application services got the third and last place with a relative weight (62.12%). The results also showed that there are statistically significant differences between banks operating in Palestine according to the bank variable from the beneficiaries' point of view in favor of Bank of Palestine. The results showed that there were no statistically significant differences between banks operating in Palestine according to the variable number of years of dealing with the bank from the point of view of beneficiaries. The study made a number of recommendations, the most important of which are: The need for banks to enhance the use of electronic banking services and upgrade them. Conduct awareness campaigns on the importance of electronic banking services and give appropriate incentives to beneficiaries who deal with them. BackgroundBurnout is a syndrome that results from stressors in the work environment that have not been successfully managed. The prevalence of burnout among schoolteachers was always controversial. COVID-19 pandemic added more stressors to teachers since they had to change their working styles in response to the pandemic lockdowns or curfews. In Saudi Arabia, the prevalence and determinants of burnout among school teachers were not measured by any other group during the COVID-19 pandemic stressors.MethodsA cross-sectional survey was conducted among 879 teachers (...) in the Jazan region, Saudi Arabia, using the Maslach Burnout Inventory, during April 2021. Multistage cluster random sampling was used.ResultsThe mean age of the participants was 41.4 years. Male teachers represented 52.6% of the participants while females represented 47.4%. Most teachers showed burnout symptoms. Consequences of burnout were observed, such as using psychotropic medications, absenteeism, lack of job satisfaction, and changing schools. Using the MBI scale, most teachers showed medium or high emotional exhaustion, low depersonalization, and low personal accomplishment.ConclusionMost teachers showed symptoms of burnout during the COVID-19 pandemic. Being an expert and ability to adapt to technology during the COVID-19 pandemic proved to effectively reduce burnout symptoms. Increasing incentives, early detection, and improving the work environment is recommended to diminish burnout consequences. (shrink)

The study aimed to identify the level of promotion of entrepreneurship in the technical colleges in Palestine. The analytical descriptive method was used in the study. A questionnaire of 41 items was randomly distributed to the technical colleges in the Gaza Strip. The random sample consisted of (275) employees from the mentioned colleges, and the response rate were (74.5%). The results of the study showed that the technical colleges achieved a high level of promotion of entrepreneurship with a relative weight (...) of 73.45%. The results of the study showed that there is a high level of promotion of entrepreneurship (risk, preparedness, proactive competition, innovation orientation) in the technical colleges in Gaza Strip. The field of competition came in first place with a relative weight of 76.65%. In the second place came the field (the trend towards innovation) and relative weight (74.96%). In the third place came the field of pre-emptive preparedness with a relative weight of 74.07%. In the fourth and last place came the field of risk and a relative weight of 68.39%. The results confirmed that there are statistically significant differences in the promotion of entrepreneurship in the technical colleges in Gaza Strip due to the college variable in favor of UCAS. The results confirmed that there is no statistically significant relationship in the promotion of entrepreneurship in technical colleges in Gaza Strip due to the variable level of employment. The researchers suggest a set of recommendations, the most important of which is to draw the attention of the technical colleges to the importance of promoting entrepreneurship, because of their role in reducing the problem of unemployment, the importance of linking technical education and promoting entrepreneurship to the Palestinian society in general and Gaza Strip in particular. The importance of urging decision-makers in technical colleges to promote interest in leadership and to put their own courses in all technical education programs in these colleges, as well as enhancing the technical, technological and technical capabilities of technical education and keeping pace with the latest international standards by providing the necessary material resources. There is a need to urge researchers to conduct further studies of the future which deal with the same variables of the current study in the field of entrepreneurship and applied to other sectors. The study aimed at measuring the dominant pattern of leadership and its relation to the performance of the administrative staff in the Palestinian universities. The study community consists of all the administrative staff from Al-Azhar University and the Islamic University, and through the census of the study society it was found to consist of (655) administrative staff. In order to achieve the objectives of the study, the researchers used the method of random sample in the study, and the study was (...) conducted on a sample of (221) administrative staff of the surveyed universities and the response rate was (82.35%). The study found that there is a high degree of satisfaction with the Dominant Pattern of Leadership in the Palestinian universities in Gaza Strip from the point of view of the administrative staff, which reached (71.67%). There is a high level of performance from the point of view of administrative staff, with a percentage of (82.53%). There is a direct correlation between the dominant pattern of leadership and the functional Performance of Administrative Staff, the absence of differences between the sample according to the gender variable in their perception of the dominant pattern of leadership and the functional Performance of Administrative Staff, the absence of differences in the perception of employees of the dominant pattern of leadership and the functional Performance of Administrative Staff depending on the age variable. There are differences of statistical significance according to the variable of scientific qualification in the Dominant Pattern of Leadership, while there were no differences in performance, the differences in the dominant pattern of leadership according to the scientific qualification were in favor of those who obtained the diploma degree compared to other practical qualifications, the absence of differences in the perception of employees of the dominant pattern of leadership and the functional Performance of Administrative Staff depending on the variable years of service, the absence of differences in the perception of employees of the dominant pattern of leadership and the functional Performance of Administrative Staff depending on the variable level of career (Director, Head of Department, and Administrative Officer). There were differences in the perception of workers to the dominant pattern of leadership depending on the variable of the workplace, where there were differences in favor of workers in deanships and colleges compared with the workers in the technical departments. While there were no differences in job performance according to the workplace variable, the existence of differences in the perception of workers to the dominant pattern of leadership depending on the university in which they work in favor of the Islamic University and the absence of differences in performance between the Islamic University and Al-Azhar University. The study reached a number of recommendations, the most important of which is that the interest of the managements of the Palestinian universities in improving the dominant pattern of leadership, to give universities the opportunity to participate in decision-making, the continued administration of universities interest and continuous improvement of the performance of its employees, enhance the periodic evaluation of job performance and to inform employees and express their opinion, solving workers' problems and giving them the opportunity to contribute to solving their own problems, the use of the staff rotation method periodically and strengthening the democratic the dominant pattern of leadership and empowering university staff. -/- . Experiments (E), computer simulations (CS) and thought experiments (TE) are usually seen as playing different roles in science and as having different epistemologies. Accordingly, they are usually analyzed separately. We argue in this paper that these activities can contribute to answering the same questions by playing the same epistemic role when they are used to unfold the content of a well-described scenario. We emphasize that in such cases, these three activities can be described by means of the same conceptual framework—even (...) if each of them, because they involve different types of processes, fall under these concepts in different ways. We further illustrate our claims by presenting a threefold case study describing how a TE, a CS and an E were indeed used in the same role at different periods to answer the same questions about the possibility of a physical Maxwellian demon. We also point at fluid dynamics as another field where these activities seem to be playing the same unfolding role. We analyze the importance of unfolding as a general task of science and highlight how our description in terms of epistemic functions articulates in a noncommittal way with the epistemology of these three activities and accounts for their similarities and the existence of hybrid forms of activities. We finally emphasize that picturing these activities as functionally substitutable does not imply that they are epistemologically substitutable. (shrink)

Knowledge can be transmitted through testimony. What about understanding? In this paper I argue against the possibility of testimonial understanding by giving an account of understanding in terms of ‘mental structures’. Then I argue while we cannot integrate communicating understanding into a propositional model of epistemic communication, we can do so on a perspectival model. I highlight the importance of this to the epistemology of education throughout.

The study aimed to identify the reality of the use of social networks in the technical colleges in Palestine, where the variables of social networks were included. The analytical descriptive method was used in the study. A questionnaire consisting of (12) items was randomly distributed to college workers Technology in the Gaza Strip. The sample of the study consisted of (205) employees of these colleges. The response rate was 74.5%. The results showed a high degree of approval for the dimensions (...) of the social networks and a relative weight (74.15%) according to the perspective of the employees of the technical colleges in the Gaza Strip. The results of the study showed that there is a high level of social networking areas (site management and Website Content) in the technical colleges in the Gaza Strip. The field of site management ranked first with a relative weight of 74.91%, and second and last (Content Site) with a relative weight (73.38%). The results showed that there were differences between colleges in the use of social networks where the results showed that the most common colleges used these networks (UCAS) and the least used is (GTC). The results showed no differences between male and female employees in the use of social networks in technical colleges. The researchers suggest a number of recommendations, including: the need to raise awareness of the importance of Facebook and other social networking sites, through the holding of courses for employees in technical colleges, and to identify the ways to optimize the use of such sites, and the benefits of this use, and reflected positively on technical colleges. And the adoption of dealing with the various social networking sites as a reality, and the Palestinian and Arab technical colleges, use them in accordance with the objectives of technical colleges. Advise the Department of Technical Colleges to devote time to their presence on social networks to follow the public and respond to their queries. There is a need for the attention of decision-makers in technical colleges in social sites, because they are considered an important and effective means of communication, and the link between beneficiaries and decision-makers. There is a need to promote the use of modern electronic means of work and the need to increase the link of customers to the college through electronic services. (shrink)

Statistical distributions play a prominent role for modeling data in applied fields, particularly in actuarial, financial sciences, and risk management fields. Among the statistical distributions, the heavy-tailed distributions have proven the best choice to use for modeling heavy-tailed financial data. The actuaries are often in search of such types of distributions to provide the best description of the actuarial and financial data. This study presents a new power transformation to introduce a new family of heavy-tailed distributions useful for modeling heavy-tailed (...) financial data. A submodel, namely, heavy-tailed beta-power transformed Weibull model is considered to demonstrate the adequacy of the proposed method. Some actuarial measures such as value at risk, tail value at risk, tail variance, and tail variance premium are calculated. A brief simulation study based on these measures is provided. Finally, an application to the insurance loss dataset is analyzed, which revealed that the proposed distribution is a superior model among the competitors and could potentially be very adequate in describing and modeling actuarial and financial data. Current approaches used in educational research and practice to evaluate the quality of written arguments often rely on structural analysis. In such assessments, credit is awarded for the presence of structural elements of an argument, such as claims, evidence, and rebuttals. In this article, we discuss limitations of such approaches, including the absence of criteria for evaluating the quality of the argument elements. We then present an alternative framework, based on the Rational Force Model (RFM), which originated from the work (...) of a Nordic philosopher Næss. Using an example of an argumentative essay, we demonstrate the potential of the RFM to improve argument analysis by focusing on the acceptability and relevance of argument elements, two criteria widely considered to be fundamental markers of argument strength. We outline possibilities and challenges with using the RFM in educational contexts and conclude by proposing directions for future research. (shrink)

This article develops a philosophical hermeneusis of the “Valladolid Debate” centered on the notion of “universality”, highlighting the universalist elements present both in the foundation of a praxis of colonial domination developed by Juan Ginés de Sepúlveda and in the recognition of the cultural diversity held by Bartolomé de las Casas. First, the historical-ideological context of the conquest is presented. Subsequently the article analyzes de Sepulveda’s arguments about barbarism, cultural superiority and the right of domination, which established a “logic of (...) cultural domination”. In this context, de Sepúlveda intended to establish a fracture between “civilized” and “barbaric” cultures, in which the human essence revealed itself deficiently. Finally, the contribution considers the objections to the “colonial fracture” presented by de las Casas, who composes an alternative position resignifying the concept of “universality” that inhabited de Sepúlveda’s differentialist arguments. Background: Concerns have been expressed regarding the adequacy of ethics review systems in developing countries. Limited data are available regarding the structural and functional status of Research Ethics Committees (RECs) in the Middle East. The purpose of this study was to survey the existing RECs in Egypt to better understand their functioning status, perceived resource needs, and challenges. Methods: We distributed a self-administered survey tool to Egyptian RECs to collect information on the following domains: general characteristics of the REC, membership (...) composition, ethics training, workload, process of ethics review, perceived challenges to effective functioning, and financial and material resources. We used basic descriptive statistics to evaluate the quantitative data. Results: We obtained responses from 67% (12/18) of the identified RECs. Most RECs (10/12) have standard operating procedures and many (7/12) have established policies to manage conflicts of interests. The average membership was 10.3 with a range from 7-19. The predominant member type was physicians (69.5% of all of the REC members) with little lay representation (13.7%). Most RECs met at least once/month and the average number of protocols reviewed per meeting was 3.8 with a range from 1-10. Almost three-quarters of the members from all of the 12 RECs indicated they received some formal training in ethics. Regarding resources, roughly half of the RECs have dedicated capital equipment (e.g., meeting room, computers, office furniture, etc); none of the RECs have a formal operating budget. Perceived challenges included the absence of national research ethics guidelines and national standards for RECs and lack of ongoing training of its members in research ethics. Conclusion: Our study documents several areas of strengths and areas for improvements in the operations of Egyptian RECs. Regarding strengths, many of the existing RECs meet frequently, have a majority of members with prior training in research ethics, and have written policies. Regarding areas for improvements, many RECs should strive for a more diverse membership and should receive more financial resources and administrative support personnel. We recommend that RECs include more individuals from the community and develop a continuing educational program for its members. Institutional officials should be aware of the resource capacity needs of their RECs. (shrink)

On October 27, 1991, a Jewish woman named Rachel Drouk, a settler in the West Bank, was killed by Palestinian Intifada fighters. Twenty-five women spontaneously gathered at the site of the murder and held a vigil—a vigil that eventually developed into a protest settlement. The women, all of whom were married mothers, presented their initiative in maternal narratives: grounds, motives, and justifications for the act, and targets and anticipations were all related to the practice of care. The insight phenomenon is thought to comprise two components: cognitive and affective. The exact nature of the Aha! experience remains unclear; however, several explanations have been put forward. Based on the processing fluency account, the source of the Aha! experience is a sudden increase in processing fluency, associated with emerging of a solution. We hypothesized that in a situation which the Aha! experience accompanies the solution in, the problem would be judged as less difficult, regardless of the objective difficulty. We (...) also planned to confirm previously discovered associations between the Aha! experience and accuracy, confidence, and pleasure. To test the proposed hypothesis, during the preliminary stage of the study, we developed a set of 100 remote associate problems in Russian and asked 125 participants to solve problems and indicate the Aha! moment, confidence, difficulty, and likability of each problem. As expected, the Aha! experience often accompanied correct solutions and correlated with confidence judgments. We also found a positive correlation between the Aha! experience and problem likability. As for the main hypothesis, we confirmed that the Aha! experience after the presentation of the solution was associated with a decrease in subjective difficulty. When participants could not solve a problem but experienced the Aha! moment after the solution was presented to them, the problem was perceived as easier than one without the Aha! experience. We didn’t find the same effect for the Aha! after solution generation. Thus, our study partially supports the processing fluency account and demonstrates the association between the Aha! experience and metacognitive judgments about the accuracy and difficulty of problems. Mostramos que seu principal proponente, James Lovelock, pretendeevitá-las devido a uma interpretação equivocada da natureza de taisexplicações. Na tentativa de evitar compromissos com a teleologia,Lovelock recorre ao conceito de propriedades emergentes. Esta não é,contudo, uma saída consistente, porque os conceitos de propriedadesemergentes e teleologia não são mutuamente excludentes. Com base nos argumentos apresentados ao longo do artigo,sugerimos uma reorganização da estrutura do programa de pesquisa Gaia,visando à continuação de seu progresso teórico e empírico.In this paper, we discuss the role of teleological explanations in Gaia theory.We show that its main proponent, James Lovelock, intends to avoid themdue to a misinterpretation of the nature of teleological explanations. Inorder to avoid a commitment to teleology, Lovelock appeals to the conceptof emergent properties. This is not a consistent solution, however, since the concepts of emergent properties and teleology are not mutuallyexclusive. We also discuss difficulties in an interpretation of Gaia from ateleonomic perspective, discussing problems such as that of the notion ofsuperorganism. In order to appraise the status of teleological explanationsin Gaia, we examine the case of the interaction between algae and clouds,which gave birth to a new research field and show the theoretical andempirical contributions that Gaia can bring. Based on the argumentsdeveloped in the paper, we suggest a reorganization of the structure ofGaia research program, in order to go on with its theoretical and empiricalprogress. (shrink)

In this paper, a complex non- linear programming problem with the two parts (real and imaginary) is considered. The efficient and proper efficient solutions in terms of optimal solutions of related appropriate scalar optimization problems are characterized. Also, the Kuhn-Tuckers' conditions for efficiency and proper efficiency are derived. This paper is divided into two independently parts: The first provides the relationships between the optimal solutions of a complex single-objective optimization problem and solutions of two related real programming problems. This commentary is a critical appraisal of Gil-Pérez et al.'s (2002) conceptualization of constructivism. It is argued that the following aspects of their presentation are problematic: (a) Although the role of controversy is recognized, the authors implicitly subscribe to a Kuhnian perspective of `normal' science; (b) Authors fail to recognize the importance of von Glasersfeld's contribution to the understanding of constructivism in science education; (c) The fact that it is not possible to implement a constructivist pedagogy without a constructivist epistemology (...) has been ignored; and (d) Failure to recognize that the metaphor of the `student as a developing scientist' facilitates teaching strategies as students are confronted with alternative/rival/conflicting ideas. Finally, we have shown that constructivism in science education is going through a process of continual critical appraisals. (shrink)
